THE ESSENTIALS
Before you start
- The law provides for care after discharge in cases of recurrence or aggravation.
- Treatment and temporary incapacity payments are different questions.
- The connection to the accident and the dates require assessment in the actual case.
Discharge does not remove the recurrence rule
Article 24 of Law 98/2009 preserves entitlement to benefits in kind after discharge in cases of recurrence or aggravation, including illnesses related to the accident’s consequences. Benefits in kind are care and other support, separate from the cash payments described in Article 23.
This does not classify a new pain merely from this article’s title. Tiago identifies the accident reference, what changed and when. Clara separates facts he can describe from the clinical connection requiring assessment. He should not invent a cause or change dates in a report to obtain a particular result.
Renewed incapacity and the gap after discharge
For recurrence or aggravation, Article 24 provides for temporary incapacity payments after renewed certification. It also covers the gap from discharge if renewed incapacity is certified within eight days. That period concerns the gap-payment rule; it is not a general eight-day limit for seeking treatment after discharge.
Fictional exercise: Tiago notes discharge, return to work, renewed difficulties and the next clinical assessment. He does not calculate payable days himself or treat a missing transfer as a clinical decision. He requests a response distinguishing the period recognised, outstanding matters and the reason given.
Keep documents explaining the dates
Articles 35 and 36 govern the discharge report and access to case documents. The insurer immediately supplies information on temporary incapacity periods and degrees and, where relevant, discharge and why treatment ended. The worker may request copies of clinical documents held by the insurer.
To prepare the enquiry, Tiago organises the discharge document, case reference and new assessment information. He uses the designated private channel. He gives his employer information needed for the employment situation without turning clinical reports into a group conversation or social media post.
Further care and pension review are different requests
Clara separates assessment and possible further care from discussion of a previously fixed benefit. Article 70 concerns review following a change in working or earning capacity. A question about treatment after discharge should not be reduced to asking how much a pension pays.
State which issue you want clarified. For disagreement about clinical findings or rights, seek appropriate help for the case, including legal assistance where necessary. Do not wait for a new insurance quote to address the earlier accident. Check the accident date and the regime applicable to it too.
Use the route for an existing case
Use policy support to organise the case reference and question. A new work accident insurance proposal assesses future protection; it neither validates recurrence nor confirms payment for care or incapacity days following an earlier accident.
Tiago ends the conversation with a list of documents supplied and responses still awaited. Clara does not replace the doctor, insurer or court in assessing the matter. Seek timely clinical guidance when care is needed; this guide determines no individual injury, incapacity degree or amount.
KEEP THESE QUESTIONS
Your checklist for the next conversation
- Collect the accident reference, discharge document and dates of changes.
- Request assessment and separate care from incapacity payments.
- Check the information supplied and request the copies needed.
- Use the appropriate route for disputes without publishing clinical data.
