THE ESSENTIALS
Before you start
- Insurance and prevention have different functions.
- Culpable employer conduct can have separate consequences.
- A missing record does not automatically determine cause or cover.
Insurance does not erase statutory responsibility
Articles 18 and 79 of Law 98/2009 distinguish compulsory risk transfer from aggravated responsibility for culpable conduct or failure to observe safety rules in the statutory circumstances. Article 79(3) provides for the insurer to pay the benefits due without that conduct, without prejudice to recourse. Neither «insurance pays everything» nor «insurance pays nothing» accurately summarises the regime.

Organise two lists that can be checked together
First identify who works, for whom, on which tasks and at which locations, alongside the information declared for insurance. Separately organise applicable prevention measures, who oversees them and existing records. Describing a task in a policy does not establish that its execution is technically safe.
Fictional example: a condominium employs someone for routine maintenance. Its administrator gathers the job description and asks a competent professional about conditions for a task at height. The existence of insurance is not treated as technical permission to start.
Use records to clarify the facts
Keep relevant information about training, instructions, maintenance and measures actually implemented, with dates and responsible persons. Distinguish existing documents, missing information and planned actions. Do not retrospectively manufacture records as though they predated an event.
Following an accident, assistance and applicable procedures must not wait for an informal argument about fault. Organise facts and follow the notification process. Legal responsibility requires the particular circumstances; this guide does not decide an employer's or worker's conduct.
Review protection against the current activity
For a workers' accident quotation from RMACHADO, start with actual working relationships, tasks and locations. Safety questions belong with competent professionals in that field. Health information, identity documents and case material should use the appropriate channel, never public comments.
KEEP THESE QUESTIONS
Your checklist for the next conversation
- Separate insurance from prevention.
- Describe work relationships and tasks.
- Identify responsibility for applicable measures.
- Keep genuine dated records.
- Notify events without deciding fault in advance.
