THE ESSENTIALS
Before you start
- Ending a policy does not automatically erase a payment due for an earlier covered event.
- The policy period and indemnity period are different calendar entries.
- A maximum duration does not promise full payment throughout it.
The law distinguishes termination from an earlier claim
Article 106(2) of Portugal’s Insurance Contract Law provides that termination does not prejudice the insurer’s benefit arising from covered risk when the insured event precedes or coincides with termination, even if it caused termination. This concerns a benefit due for covered risk; it does not turn an excluded occurrence into a payable claim.
Nuno notes what must be established: the event’s date and applicable benefit. Clara does not assume the café has business-interruption cover merely because it has a multi-risk policy. That benefit and the event that could trigger it must first be located in the contract.
A contractual example explains the two end dates
In Allianz MR Empresa 2064–12/2021_1, the indemnity period starts at the event and runs as needed to restore normal operations, up to 12 months; subsequent expiry, suspension or termination does not interrupt it. Optional condition 29 depends on its specified events and requirements. This is a contractual example, not a product recommendation or universal duration rule.
A stated maximum should not be copied as a guaranteed year of payments. Nuno asks which period was actually agreed, which economic benefit is being assessed and what other limits apply. The response must address his contract’s terms, beyond an insurance product’s name.
Build a timeline that explains the loss
For preparation, use three entries: policy period; event date and reference; interruption consequences and resumption. Connect each document to its relevant phase. An invoice arriving after termination and an event occurring after termination are different facts and should be described differently.
In the fictional exercise, Nuno finds a repair forecast and an estimate for restarting the café. He retains both with their reasons and marks what remains unconfirmed. This supports a precise question about the period being assessed, without labelling all expected turnover as accepted loss.
Separate the existing claim from future protection
If a claim already exists, retain its reference and request a reasoned response about the benefit and period considered. This guide does not decide an expense’s eligibility or an amount. It also does not suggest stopping payments or cancelling a policy to test the rule.
For the café’s future continuity, Nuno prepares a separate conversation: which risks should be compared, and from what date? Use Support and claims for a current event; for new protection select Business multi-risk in Request a quote. A new quotation does not retrospectively resolve a known event.
KEEP THESE QUESTIONS
Your checklist for the next conversation
- Separate the event date, contract ending and indemnity period.
- Locate the benefit and terms actually agreed.
- Organise the timeline and records for each phase.
- Handle the existing claim and future protection separately.
