Practical guide · Insurance under a finance lease

Is insurance for a leased asset only a bank requirement?

This is more than a commercial financing condition. Portuguese finance-lease law includes an insurance duty for the lessee, the party using the asset under that agreement. You must then check how the policy and the lease put the protection into effect. This guide concerns financial leasing; do not extend its conclusion to every rental or loan.

THE ESSENTIALS

Before you start

  • Read the legal duty within the financial-leasing framework.
  • The lease and the insurance policy answer different questions.
  • A paid instalment or insurance quotation does not, by itself, prove the required protection.

What the law provides

Article 10(1)(j) of Decree-Law 149/95 includes, among the lessee’s obligations, insuring the asset against loss or deterioration and the resulting damage. This reference comes from the consolidated text consulted in Diário da República, rather than a commercial list of benefits.

The provision does not establish that a particular quotation meets every financing requirement or that every loss will be paid. First identify the type of agreement and the asset to which the duty relates.

Tiago compares the duty with the available documents

Fictional Bairro Seguro example: Tiago Faria considers a machine under a finance lease for his work. The monthly instalment fits his budget, but he does not yet know what insurance has been arranged. Clara Mota helps him separate three documents: the lease agreement, the requirements received from the lessor and the insurance proposal.

Tiago prepares a table listing the equipment and serial number, stated value, dates, requested benefits and clause references. He marks every difference for clarification. His aim is to understand any unmet requirement before choosing the lowest premium.

Checking the proposal without assuming equivalence

Ask where the proposal addresses each lessor requirement: asset, use, location, duration, sum insured, excesses and rights to any claim payment. A label such as “Leased Assets” does not replace that comparison.

If the equipment or its use also involves a specific compulsory insurance obligation, clarify it separately. Property protection does not automatically demonstrate compliance with every duty associated with the activity or use of the asset.

Before delivery and throughout the agreement

Establish who follows up the insurance application, issue and renewal, and which documents must go to the lessor. Keep the replies and compare the issued contract with the proposal reviewed. An indication of price is not proof of insurance in force.

If the equipment is replaced, its use changes or the lease ends, request a review of the relevant documents. Do not assume a financing change has been communicated to and accepted under the insurance. For a future proposal, select Bens em Leasing in “Request a quote” on the RMACHADO website. For an occurrence already known, use Policy and claims support.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Confirm that the agreement is a finance lease and identify the asset.
  • Compare the legal duty, the lessor’s requirements and the proposal.
  • Clarify benefits, dates, sums insured, excesses and each party’s rights.
  • Keep issued documents and review changes through the appropriate channel.
