THE ESSENTIALS
Before you start
- Buying the replacement is not the insurer choosing the claim benefit.
- The new equipment needs its own identification in the insurance review.
- The outcome for the financing must be confirmed with the lessor.
Who chooses how the benefit is provided?
In the MAPFRE Bens em Leasing wording, code 34220220500, article 25 reserves the insurer's option to pay money or replace, reinstate, repair or rebuild the affected asset. A purchase made by the customer does not exercise that option on the insurer's behalf. This is a policy example, without a product recommendation.
Nuno takes the quotation to the claim handler and asks: is replacement by the insurer, a cash payment or another solution being considered? If he is thinking of buying before the answer, he asks how that initiative would be treated. Clara neither turns the café's urgency into authorisation nor declares buying prohibited.
The damaged asset and its replacement have different identities
Clause 1 of Fidelidade Bens em Leasing CG045, September 2026, defines insured assets through their identification in the policy schedule and their connection to the finance lease. Another machine doing the same job does not establish that it is already the subject of that policy.
As a preparation method, Clara places two records side by side. One identifies the machine involved in the claim; the other shows the replacement's make, model, available serial number, user and planned acquisition. Nuno marks anything that remains only a supplier proposal. He does not copy the old identifier into the new record.
Physical replacement does not settle the financing
Article 25 of the MAPFRE example provides for payment to the lessor in total-loss cases. That product rule does not establish that buying another asset creates a new lease, transfers the old one or settles any financial difference.
Nuno asks the lessor to identify the solution actually accepted for the replacement equipment and the documents that formalise it. He keeps that answer with the claim decision. A supplier ready to deliver and an intention to obtain financing still leave open who acquires the asset and under which agreement.
Before delivery, confirm which asset is insured
For the replacement's protection, Nuno supplies its new record and the planned delivery and first-use dates. He asks which document identifies that equipment in the insurance and when it takes effect. Clara distinguishes closing the old machine's claim from the answer about the new machine's future risks.
If temporary hire is proposed, they describe it as such, with its relevant period, rather than calling it permanent replacement. The review does not confirm cover, acceptance or payment. This exercise explains questions for those responsible for the contracts; it does not assess an actual purchase or financing arrangement.
