Moving a leased machine to Spain: does insurance follow the new location?

A business opens a Spanish installation and plans to move a leased machine there. The asset and financing payments remain, but its location changes. Before transport, review both contracts and seek answers for movement and destination use rather than assuming continuity within the European Union.

THE ESSENTIALS

Before you start

  • Keeping the asset and lease does not establish insurance territory.
  • Lessor confirmation and insurer acceptance are separate.
  • Transport, reinstallation and destination use require their own questions.

An express territorial limit in current terms

Clause 5 of Fidelidade's September 2026 leased-equipment CG045 limits benefits to losses in Portugal unless particular conditions or an endorsement expressly agree otherwise. This specific example does not establish that a policy follows equipment into Spain merely because it is another EU country.

Compare the move with the financing agreement

Identify the asset, using entity and destination installation. Consult the lease and ask the lessor about the intended transfer rather than inventing universal permission or treating silence as consent. Expressly describe any change of user or entity at the destination.

Fictional example: a Portuguese company plans to move a machine to its Spanish unit next month. It prepares the description and intended dates for lessor and insurance assessment. Its internal relocation decision is neither financial permission nor acceptance of a contractual amendment.

Describe three phases with recognisable boundaries

Separate transport, reinstallation and use at the new site. Identify responsible parties, means and proposed dates, marking unconfirmed details. An answer about operating territory alone does not settle loading, travel, unloading or assembly.

Ask the proposal or amendment to identify the locations, uses and periods assessed. If another policy or contractor addresses a phase, request its reference and interaction. Avoid a gap where every participant assumes someone else's contract provides the answer.

Keep confirmation before relying on continuity

Distinguish enquiry, reply, acceptance and amendment-effective dates. A quote mentioning the destination country does not prove the current contract has changed. Compare final documents with the machine, entity and phases described, clarifying differences before relying on them.

For a RMACHADO leased-equipment review, identify the country change. Assessment grants no permission under the financing agreement, validates no local obligations and confirms no cover for a transfer not yet accepted. An occurrence already suffered requires the existing policy's case procedure.

KEEP THESE QUESTIONS

Your checklist for the next conversation

  • Identify the country, site, user and intended date.
  • Clarify the lease with the lessor.
  • Request transport, reinstallation and destination-use assessment.
  • Check insurance acceptance, documents and effective dates.
