I have two Personal Accident policies: can both pay?

Beatriz Rocha finds an individual Personal Accident policy and another group policy. In this fictional story, she asks whether two contracts mean receiving twice as much. Clara Mota first separates the type of benefit: a predefined capital benefit is different from reimbursing a treatment bill.

THE ESSENTIALS

Before you start

  • Predetermined benefits may accumulate unless otherwise agreed.
  • An indemnity expense does not become two expenses because two policies exist.
  • Disclose other insurance for the same risk and seek assessment of each benefit.

Start with the type of benefit

Article 180(1) of Portugal’s Insurance Contract Framework permits, unless otherwise agreed, predetermined benefits to accumulate with others of the same kind or with indemnity benefits, even when linked to the same event. It is therefore incorrect to say that two personal insurance policies can never pay for one accident.

This does not permit automatically adding every headline sum insured. Beatriz identifies the cover in each contract, the event that triggers it and any clause preventing accumulation. A disability benefit may require its own assessment table and calculation method; the advertised sum is not an assessment of an actual injury.

Treatment reimbursement needs a different reading

Article 180(2) refers indemnity benefits for the same risk to Article 133. Under that framework, payment relates to the loss within each contract’s obligation. Having two policies does not permit presenting the cost borne as though none of it has yet been reimbursed.

Clara creates two logical files: predefined capital or other benefits, and expenses requiring evidence. If Beatriz has received a reimbursement, she records it and keeps the statement. The remaining cost is information for assessment, not an amount automatically payable by the other insurer.

The other contract must be disclosed

Article 180(3) requires informing the insurer about existing or newly arranged insurance for the same risk, including contracts providing only predetermined benefits. For indemnity cover, Article 133 requires disclosure to insurers when the overlap becomes known and when claiming; fraudulent omission has its own consequences.

Beatriz identifies the contracts and asks which channel and information are required. She does not replace that information with “I have another card” or conceal an earlier payment. Disclosure neither automatically cancels a policy nor establishes that both contracts cover the same activity, person or accident.

Request an answer for each benefit and contract

For each policy, seek a response about the benefit invoked, its requirements, evidence and interaction with the other insurance. Record what was paid, declined or remains pending. A treatment-expense answer may be correct without answering a disability capital claim.

To compare future protection, select Acidentes Pessoais under Request a quote at RMACHADO and mention the existing insurance. For an earlier accident, use policy support; a new request does not cover the event retrospectively. Do not automatically transfer this explanation to Health insurance, which has its own rule in Article 215.
